Establishes the procedure to withdraw from the compact. Makes conforming changes.

Allows the civil rights commission (commission) to investigate violations and enforce compliance. Provides that the commission may impose a civil penalty of $75 for each violation. Establishes certain notice requirements. Requires that the commission waive a civil penalty if an owner or operator complies not later than 30 days after a notice is mailed for the first violation.

Requires the office of the secretary of family and social services (office) to establish the fee based upon the best available data. Requires a provider organization to be assessed the fee. Provides that the office shall make expenditures from the fund in a manner consistent with applicable federal law. Requires the office to establish and distribute a schedule of payment amounts in a manner that reduces the gap between Medicaid rates and average commercial rates. Requires the office to consult with the Indiana emergency medical services association in the development and implementation of the payments. Specifies that the fee is in addition to, and does not replace, any state general fund appropriations to support provider organization reimbursements. Prohibits the office from lowering Medicaid rates for provider organizations as a result of the fee.

SB 78: 1977 pension and disability fund.

Mike Andrade co-sponsored SB 78 which provides that after July 1, 2022, if the board of trustees of the Indiana public retirement system (system board) determines that a new police officer or firefighter in the public employees’ retirement fund (PERF) should be a member of the 1977 fund, the system board shall require the employer to transfer the member into the 1977 fund and contribute the amount that the system board determines is necessary to fund fully the member’s service credit in the 1977 fund for all service earned as a police officer or firefighter in PERF. Provides that a police officer or firefighter who is an active member of the 1977 fund with an employer that participates in the 1977 fund, separates from that employer, and more than 180 days after the date of the separation becomes employed as a full-time police officer or firefighter with the same or a second employer that participates in the 1977 fund, is a member of the 1977 fund without meeting the age limitations under certain circumstances. Mike Andrade co-sponsored SB 262 which provides an affordable and workforce housing state tax credit against state tax liability to a taxpayer for each taxable year in the state tax credit period of a qualified project in an aggregate amount that does not exceed the product of a percentage between 40% and 100% and the amount of the taxpayer’s aggregate federal tax credit for the qualified project. Provides that an eligible applicant must apply to the Indiana housing and community development authority for an award of an affordable and workforce housing state tax credit. Provides that a holder of an affordable and workforce housing state tax credit may transfer, sell, or assign all or part of the holder’s right to claim the state tax credit for a taxable year.

Sets forth the following within the new article: (1) Definitions of various terms that apply throughout the article. (2) Exemptions from the bill’s requirements concerning the responsibilities of controllers of consumers’ personal data. (3) The rights of an Indiana consumer to do the following: (A) Confirm whether or not a controller is processing the consumer’s personal data. (B) Correct inaccuracies in the consumer’s personal data that the consumer previously provided to a controller. (C) Delete the consumer’s personal data held by a controller. (D) Obtain a copy or representative summary of the consumer’s personal data that the consumer previously provided to the controller. (E) Opt out of the processing of the consumer’s personal data for certain purposes. (4) The responsibilities of controllers of consumers’ personal data. (5) The roles of controllers and processors with respect to a consumer’s personal data. (6) Requirements for data protection assessments by controllers of consumers’ personal data. (7) Requirements for processing de-identified data or pseudonymous data. (8) Limitations as to the scope of the new article. (9) The authority of the attorney general to investigate and enforce suspected or actual violations of the new article. (10) The preemption of local rules, regulation, and laws regarding the processing of personal data.

Prohibits a court from assessing a civil penalty or voiding a final action, decision, or policy adopted by the governing body at a meeting held after December 31, 2020, and before January 1, 2022, without any members being physically present.

Mike Andrade authored HB 1316 which provides that, to the extent that the definition of the Internal Revenue Code (IRC) in Title 6 of the Indiana Code is not updated by amendment in the 2021 session or thereafter to conform with the CARES Act and its related amendments, a taxpayer is entitled to an exemption from state adjusted gross income equal to the amount of income associated with forgiveness of a covered loan under the Paycheck Protection Program of the CARES Act that is excluded from the taxpayer’s federal gross income under Section 1106(i) of that Act, but otherwise included in the taxpayer’s state adjusted gross income based on the definition of the IRC in Title 6 of the Indiana Code.

Rep. Mike Andrade authored HB 1317 which provides for a payment program for restaurants with unpaid sales tax and food and beverage taxes. Defines “state tax liability” as sales tax and food and beverage taxes incurred after February 28, 2021, and before August 1, 2021. Provides that a restaurant can enter into a payment program agreement with the department of state revenue that covers state tax liability for the prescribed time period. Provides that, upon payment of all state tax liability, the department shall abate and not seek to collect any interest, penalties, collection fees, or costs.

HB 1319: Common construction wage.

Mike Andrade authored HB 1319 which requires that, whenever the actual costs for the construction of a public improvement are at least $150,000, a contractor or subcontractor shall pay the workers employed in the performance of work for the construction of the public improvement a rate of wages that is not less than the prevailing wage determined by the commissioner of the department of labor (commissioner). Requires that employer contributions for fringe benefits paid under a bona fide collective bargaining agreement be included in the prevailing wage determination unless a contractor or subcontractor is required by federal, state, or local law to provide the fringe benefit. Provides that a prevailing wage determination is conclusive for one year from the date of the determination unless the determination is superseded by a later determination. Requires that all prevailing wage determinations be publicly available. Requires that a contract or subcontract for the construction of a public improvement contain a provision stating that the contractor or subcontractor is required to pay a rate of wages that is not less than the prevailing wage, and that, if it is determined that a worker has been paid less than the prevailing wage, the public body may terminate the contract or part of the contract and continue the work with the public body’s own work force or another contractor or subcontractor. Requires a contractor or subcontractor to make full payment of wages without any deductions, except for deductions required by federal or state law and deductions agreed to by the worker and approved by the contracting public body as fair and reasonable. Provides that, if a contractor or subcontractor fails to provide records requested by the commissioner concerning the payment of a prevailing wage, the commissioner may direct the fiscal or financial officer of the contracting public body to withhold from payment up to 25% of the contract amount and pay the workers directly any wages and fringe benefits due and payable. Requires the commissioner to distribute to all public bodies in the state a list of persons and firms that the commissioner has determined have not paid prevailing wages and prohibits a public body from awarding a contract or subcontract to a person or firm on the list for three years after the list is published. Provides mechanisms for the commissioner, workers, or an interested body to enforce violations of the prevailing wage law. Requires a contractor or subcontractor that fails to pay prevailing wages to pay as a civil penalty 75% of the difference between the prevailing wage rate and the wages paid to the workers. Deposits the civil penalties into a prevailing wage penalty enforcement fund to be used to pay expenses incurred by the commissioner in the administration and enforcement of the prevailing wage law. Prohibits a person from requesting or demanding all or a portion of a worker’s wages in exchange for employment on the construction of a public improvement. Prohibits a public body from dividing the construction of a public improvement into two or more contracts to avoid paying the prevailing wage.

HB 1320: Fireworks excise tax.

Mike Andrade co-authored HB 1006 which requires the Indiana law enforcement training board to establish mandatory training in de-escalation as part of the use-of-force curriculum, and requires de-escalation training to be provided as a part of: (1) pre-basic training; (2) mandatory inservice training; and (3) the executive training program. Establishes a procedure to allow the Indiana law enforcement training board to decertify an officer who has committed misconduct. Defines “chokehold” and prohibits the use of a chokehold under certain circumstances. Specifies that a law enforcement officer who turns off a body worn camera with the intent to conceal a criminal act commits a Class A misdemeanor. Requires an agency hiring a law enforcement officer to request the officer’s employment record and certain other information from previous employing agencies, requires the previous employing agency to provide certain employment information upon request, and provides immunity for disclosure of the employment records. Makes an appropriation to the Indiana law enforcement training academy for making capital improvements.

HB 1032: Newborn safety devices.

Mike Andrade co-authored HB 1032 which provides for placement of a newborn safety device at any facility that is staffed by an emergency medical services provider on a 24 hour per day, seven day per week basis, provided the newborn safety device: (1) is located in an area that is conspicuous and visible to staff; and (2) includes a dual alarm system that is connected to the facility and is tested at least one time per month to ensure the alarm system is in working order. Provides for placement of a newborn safety device at any fire department, including a volunteer fire department that: (1) meets the minimum response time established by the county, not to exceed four minutes; (2) is located within one mile of a hospital, police station, or emergency medical services station that meets certain requirements; (3) is equipped with an alert system that, when the newborn safety device is opened, automatically connects to the 911 system and transmits a request for immediate dispatch of an emergency medical services provider to the location of the newborn safety device and is tested at least one time per month to ensure the alert system is in working order; and (4) is equipped with an independent video surveillance system that allows at least two members of a fire department to monitor inside the newborn safety device at all times. Provides that a person who in good faith voluntarily leaves a child in a newborn safety device located at such a facility or fire station is not obligated to disclose the parent’s name or the person’s name. Makes conforming amendments.

HB 1115: Interfering with public safety.

Provides that the commission may impose the following civil penalties: (1) $50 for the first violation. (2) $150 for the second violation. (3) $300 for the third violation. Provides that if a penalty is imposed, the commission must enter into a remedial plan with the owner or operator for the first violation.

Mike Andrade co-authored HB 1332 which provides that a person who knowingly or intentionally sells real property that has an order: (1) requiring action relative to an unsafe premises; (2) that has not been modified or rescinded by the enforcement authority; and (3) that has not been disclosed to the buyer before the buyer’s purchase of the real property; commits unlawful sale of unsafe buildings, a Class C misdemeanor. However, the offense is a Level 6 felony if the person has a prior unrelated conviction for the offense. Provides that the hearing authority may impose a civil penalty on a person in an amount not to exceed five thousand dollars ($5,000) for committing the offense of unlawful sale of unsafe buildings.

Mike Andrade co-authored HB 1392 which amends as follows the law under which a provisional occupational license may be issued to the spouse of an active duty member of the armed forces assigned to Indiana: (1) Provides that the law applies to the spouse of any active military service member, including a member of a reserve component of the United States armed forces or a member of the National Guard. (2) Eliminates a provision under which a military spouse applying for a provisional occupational license is required to submit to a national criminal history background check, and provides instead that a military spouse applying for a provisional occupational license must be determined by the appropriate professional board to not have a disqualifying criminal history if a national criminal history background check is required for the regulated occupation for which the military spouse seeks a provisional license.

Requires certain mental health professionals who are making a mental health diagnosis and who determine that the patient may have a physical condition that requires medical attention or has not been examined by a physician, an advanced practice registered nurse, or a physician assistant in the preceding 12 months to: (1) advise the patient to schedule, and offer to assist the patient with scheduling, a physical examination for the patient; (2) provide the patient with a list of practitioners and certain information concerning the practitioners; and (3) coordinate patient care with the practitioner as appropriate. Requires documentation of the actions of the licensed professional in the patient’s medical record.

Provides, for any employee who is diagnosed after June 30, 2021, with a health condition caused by any variant of SARS, including COVID-19, that if the health condition results in disability or death and the employee wishes to have a presumption of disability or death incurred in the line of duty apply to the employee, the employee shall, by written affidavit executed before death, provide verification that the employee has not, outside the scope of the employee’s current employment, been exposed to another individual known to have any variant of SARS, including COVID-19. Makes technical corrections.

Provides that the right of a person with a disability to parent the person’s child may not be denied or restricted solely because the person has a disability. Provides that: (1) a court, in: (A) considering the appointment of a person as a guardian; (B) hearing an action to modify custody or an action to determine or modify parenting time; or (C) determining whether to grant a petition for adoption; and (2) the department of child services, in determining whether to grant a person a license to operate a foster family home; may not discriminate against, and shall take into consideration the provision of reasonable accommodations to, a person with a disability.

SB 396: 1977 pension and disability fund.

Mike Andrade co-sponsored SB 396 which amends the definition of “salary of a first class patrolman or first class firefighter” for the purpose of benefits paid from and contributions made to the 1977 police officers’ and firefighters’ pension and disability fund (fund). Establishes certain requirements if an employer certifies a new salary under IC 36-8-8-6.5. Changes the maximum age for an applicant to a police department from 35 to 39 years of age. Requires an employer that participates in the fund and provides longevity increases to pay an amount greater than or equal to the longevity increase paid in the previous year. Requires employers to provide reports or records requested by the system board, and permits the system board to fine the employer for each day that reports or records are late. Provides that an alleged failure of an employer to make required payments to the 1977 fund may be examined by the state board of accounts or by the Indiana public retirement system. Requires employers to submit, both annually and at the request of the system board, the salary of a first class patrolman or firefighter.
